Introduction
A big question of appointing the President of the National Company Law Tribunal (NCLT) was presented before the Delhi High Court. The Central Government reported to the Court that the appointment procedure is still pending with the Chief Justice of India (CJI) to be approved.

This issue was brought to the Delhi High Court because of the delay in the appointment of a President to the NCLT. The NCLT is quite crucial in the management of the company disputes, insolvency and corporate matters in India.
The smooth running of the tribunal and case delays were questioned due to the lack of a regular President.
What the Government Said.
At the hearing, the Central Government informed the Delhi High Court that it has started the appointment process. It made clear that the proposal to appoint the NCLT President has been forwarded and awaits the Chief Justice of India since December 2025.
The government detailed that according to the legal process, appointments like these must be consulted and approved by the judiciary and hence time is spent.

The key issue that the Court heard about was the time it took to fill such a significant office and how it affected the operations of the NCLT.
Court’s Observations
The Central Government made the statement which was observed by the Delhi High Court. The Court was concerned over the delay yet considered the fact that the case is being considered at the level of Chief Justice of India.
The Court emphasised the importance of timely appointments in tribunals to ensure that cases are decided without unnecessary delay.

The NCLT is one of the most important tribunals in India that handles the company law issues such as insolvency cases under Insolvency and Bankruptcy Code. Any form of delay in appointment might have an impact on businesses and creditors as well as the economy at
What this case brings to the fore is the need to have the government and the judiciary working together when it comes to making important appointments. Although the process is still in progress, the delay does not bode well with regard to the performance of major institutions such as the NCLT. The legal system needs to be efficient through timely decisions.
