Kapil Sibal, former Union Minister, MP, and Senior Advocate of the Supreme Court of India, is a good friend of mine, whom I have known for several decades.
There are many top lawyers of India, but I admire him most because not only is he a top lawyer he is also deeply concerned about the problems facing India ( whereas the other top lawyers only think of making a lot of money ). It is for this reason that he has started his video shows ‘Dil se’.
The problem with Kapil, however, is that while he is critical of many things in the country, he believes that the prevalent system in India can be reformed, as he expressed in his interview with me, given below :
His view is obviously because for long he has been within the system, as a senior politician and a senior lawyer, which has made him successful and prosperous, and so would not like to see it destroyed.
I too was part of the system, as a lawyer for 20 years and a Judge for another 20 years. However, I have been able to break free, after a tremendous struggle, from the fetters and chains which bound me to the system, whereas Kapil has not. I believe that the present system in India is beyond redemption, so no amount of reforms can make a significant or substantial change, and the country needs a revolution.

As I said in my interview by Kapil, there can be a building having some defects, which can be repaired, but there can also be a building which is so dilapidated and run down that no amount of repairs would do, and it requires demolition and fresh construction. India today is like that second kind of building. All our state institutions have collapsed, and our Constitution has exhausted itself and become a scarecrow.

Incremental reforms are no longer sufficient to solve India’s chronic and huge issues like massive poverty, massive unemployment, appalling level of child malnutrition ( every second child in India is malnourished, according to Global Hunger Index ), skyrocketing prices of food and other essential commodities, almost total lack of proper healthcare and good education for the masses, etc.
A fundamental restructuring of the country’s political and constitutional system, led by selfless, modern minded, and patriotic leaders, is now required, which can only come about by a revolution, after which a new political and social order will be set up under which there is rapid industrialization, and steady rise in the standard of living of the people, as it happened in China after its revolution in 1949.
In his interview of me ( see above ) Kapil said that education can solve India’s problems.

In his latest press conference Kapil raises several issues. He severely cricises Prime Minister Modi and his government, and warns of the consequences if the BJP gets a two thirds majority in both Houses of Parlament, thus enabling it to alter the Constitution and make India a Hindu state
But in my opinion Kapil does not probe deeper. Partition of India in 1947 was a British swindle done on the basis of the 2 nation theory ( that Hindus and Muslims are two separate nations who cannot live together peacefully ).

Though this bogus theory was initially propagated by Jinnah, ultimately the leaders of the Congress party ( Gandhi, Nehru, Patel, etc ) agreed to Partition, which to my mind was the greatest tragedy of India in its 5000 year old known history. So these Congress leaders are also culpable.
Once India was divided on the basis of the 2 nation theory, and Pakistan was declared an Islamic state, it logically followed that India would be a Hindu state. But it was declared a secular state with an eye on the large Muslim vote bank, which the Congress wanted to win elections. This facade could not, however, last forever, and eventually it crumbled when the BJP, which does not seek Muslim votes, and claims to represent Hindus who form 80% of India’s population, came to power in 2014. To my mind the BJP will remain in power till a revolution led by modern minded patriotic leaders ( of which I have mentioned earlier ) takes place ( which may take 10-20 years ).
The Indian Constitution claims to set up a democracy. Now democracy sounds a fine, rosy word, implying rule by the people. But we have to consider democracy not in theory or in the abstract, but how it is actually practised in India. Everyone living in India knows that parliamentary democracy, as practised in India, is largely based on caste and communal vote banks. Casteism and communalism are feudal forces that have to be destroyed if India is to progress, but parliamentary democracy further entrenches and strengthens them. So it is blocking India’s progress. How then can it be said to be a good thing ?
While China, which has no parliamentary democracy, has rapidly moved ahead, lifted 80-90 crore of its 140 crore population above the poverty line, and has almost become a superpower, we are still embroiled in issues such as the Ram Mandir and cow protection.
Kapil is not alone in fetters. Almost all so called ‘intellectuals’ in India are also in fetters, and never contemplate of a revolution.
Rather, they dread it, and are horrified by the very idea
Hence if Kapil and others want to be regarded as true intellectuals, they must carefully consider what has been said above, and break free of their fetters and chains
