Bhopal Court Denies Pre-Arrest Bail to Lawyer in Twisha Sharma Death; BNS Sections 80 (Dowry Death) & 108 (Abetment of Suicide) Applied

The lawyer, Samarth Singh, had filed an anticipatory bail plea for his case in Bhopal district court which was rejected by the court. He has married Twisha Sharma. She was 33-year-old former model of Noida died under very suspicious circumstances on May 12. She was found hanging at her in-laws’ house in the Katara Hills area. Additional Sessions Judge Pallavi Dwivedi was the judge in the case. After hearing arguments on both sides Monday, she basically said no to the pre-arrest bail.

Samarth is on the run at the moment. He is lost and can’t be found. The local police have put a 10,000 rupee reward out on his head if anyone can give them a tip which leads to his arrest. He is being pursued by six police teams on 24×7 basis. They even wrote to the passport office! They don’t want him to attempt to fly out of the country.

The police are being very serious. They applied Section 80 and Section 108 of Bharatiya Nyaya Sanhita (BNS) on him. That is dowry death, and abetting a suicide. It implies that the husband and his family did so much that she had to commit suicide.

His mother is Giribala Singh. She is a retired judge from the United States. Actually she succeeded in getting anticipatory bail. Twisha’s family is very angry about that and asked how she was able to be given relief so easily.

Samarth and Twisha got married in Delhi back in December 2025. They originally met on a matrimonial website. Five months later the girl has died.

The two families are reciting completely different stories. Samarth’s lawyers have in court papers acknowledged that Twisha suffered from serious mental health problems. They asserted that she was a drug addict. His mother even went on a press conference! She informed reporters that Twisha was receiving psychiatric treatment and was taking anti-schizophren medications. She said the young woman got violent and had trembling hands when she couldn’t get her hands on narcotics. They also presented a pregnant woman. They said that it turned bad in the house when Twisha announced her pregnancy in April and didn’t want to be a housewife.

Twisha’s family tells me that’s a lie. Her father Navnidhi Sharma said that harassment by her in-laws for dowry had started from the beginning. The family had her miscarry, according to their claim; they were mentally torturing her every day. The family handed over WhatsApp chat with the court. The messages are said to be a reflection of the type of abuse she was receiving daily. Twisha’s attorneys argued to the judge that it is “completely wrong” to label someone as “suicidal” when they’re taking simple antidepressant for their anxiety.

The Charges Explained

The police registered the case under two major chapters in the new criminal code. Dowry death is covered in the BNS Section 80. If a woman dies in an abnormal manner within 7 years of marriage then this applies. If there is any evidence of cruelty or harassment for dowry just prior to her death, then the law presumes it is a dowry death.

Then there’s the BNS Section 108. This includes helping someone to commit suicide. Means someone deliberately pushed or encouraged another person to commit suicide.

The Judge was informed the investigation was still in its infancy at the Katara Hills police. They stated that the accused family has a lot of power and influence. The husband may be allowed to remain in jail, and that will increase the chances of him destroying evidence or intimidating witnesses. The judge found that this reasoning was correct. She read the First Information Report and heard the statements from the witnesses. The primary allegations are squarely with the husband,” she said. The court didn’t think it was a good idea at this time to give him immunity from arrest.

The video evidence doesn’t help either! The footage from the house was leaked onto CCTV! It tells of what happened on the night she died. In one of the videos (around 7:20 PM) Twisha is walking while barefoot up the stairs. She is walking towards the terrace.

In another video, it’s at 8:17 PM. A man with Samarth’s face is administering CPR to her. However, it was the conduct of everyone else in the frame that upset the victim’s family. They noted the retired judge mother-in-law was simply strolling from room to room. Another person is climbing up the steps. Then, three people carry Twisha down stairs.

The lawyers for her family have brought a very simple question to court. Why did they take her so far down to the ground floor to administer CPR if she is not found hanging on the top floor? They reported the judge that it was an act. They believe that the family intentionally did the act in front of the camera so they could have a good alibi.

The Medical Reports and the Police Stand.

There are also big disagreements about the medical aspects. Bhopal Police Commissioner Sanjay Kumar came out Wednesday and said they are taking this as a suicide case. He noted that the post-mortem performed at AIIMS Bhopal has substantiated that it was an “ante-mortem hanging. That simply means that she survived hanging. The autopsy report noted some bruises on her wrist and arm and reddish marks around her neck. Those were simple, blunt force injuries, the medical board said.

The most significant piece of the autopsy is that no drugs were found in her body. This is a direct contradiction by the mother-in-law to what she told the press about marijuana and heavy narcotics.
