Section 60 of the Bharatiya Nyaya Sanhita, 2023: Concealing Plans to Commit Imprisonable Offences

The issue of individuals who, with the intent or knowledge to hide plans to conduct offenses that are punishable with imprisonment is addressed in Section 60 of the Bharatiya Nyaya Sanhita (BNS), 2023. Through the concealment of such arrangements, this provision intends to discourage individuals from providing assistance to or assisting criminal activity.

The Most Important Provisions of Section 60

Any person who, with the intent to facilitate or knowing that it is likely that he will thereby facilitate the commission of an offense that is punishable with imprisonment, voluntarily conceals, by any act or illegal omission, the existence of a design to commit such an offense, or makes any representation that he knows to be false respecting such a design, is subject to the following penalties, as outlined in Section 60:

In the event that the offense is committed, the punishment may consist of imprisonment according to the description provided for the offense, for a term that may extend to one-fourth of the longest time authorized for that offense, or a fine that is equivalent to the amount that is provided for the offense, or both.

In the event that the offense is not committed, the punishment may consist of imprisonment according to the description provided for the offense, for a duration that may extend to one-eighth of the longest time authorized for that offense, or a fine that is equivalent to the amount that is provided for the offense, or both.

An Example to Illustrate the Point

Take the following example into consideration:

It is revealed to Rahul that his close friend Amit is making preparations to heist a bank. In his knowledge, Rahul is aware that robbing a bank is a serious offense that can result in incarceration. Instead of informing the authorities about Amit’s plan, Rahul makes the decision to keep it a secret and even offers Amit assistance by giving him with information regarding the security system of the bank. The heist is eventually carried out, and Amit is apprehended for his involvement. According to Section 60 of the Bharatiya Nyaya Sanhita, 2023, Rahul may be punished with imprisonment for a period of up to one-fourth of the longest sentence that is given for the offense of robbery, or with a fine that is provided for the offense, or with both of these options.
