At long last the law comes to Nida Khan. The suspended employee of Tata Consultancy Services (TCS) got caught after evading authorities for almost two-and-a-half weeks. Last Thursday, it was found by Nashik police that she was living in a flat in Chhatrapati Sambhajinagar. Since the initial allegations of sexual harassment and compelled religious conversion emerged late in March, she’s been on the run. In what has become a major achievement in the investigation, she was arrested in the case that has left the Indian corporate world in shock
Court Slams the Door on Bail
Originally she attempted to litigate for her release while in hiding. She went to Nashik sessions court for anticipatory bail. Her defense team emphasised her three months’ pregnancy hoping to get sympathy from the bench. But her application was utterly refused by the court on the second of May. The presiding judge made some very astute remarks as she dismissed her

A Multilayered Investigation
The court did not consider it a typical workplace grievance. The judge pointed out that there seemed to be a “highly systematic plan” in place for brainwashing the victims. The bench termed the alleged offences as multi-dimensional and multi-layered and said that the same could only be done through deep custodial interrogation. Authorities had made a strong case that the bail was bound to hamper their investigation to uncover the truth. After her police remand, she was transferred to judicial custody till May 24
The weight of the charges.
The two charges leveled against the 27-year-old HR manager and her co-accused are very serious. Complaints from victims describe a very negative working culture that quickly turned into religious manipulation. Complainants alleged that Khan actively tried to make female co-workers change their dress to conform to Islamic tradition. She was known to force servants to eat non-vegetarian food, the police said. One victim even stated that she was being attempted to be moved to Malaysia and changed her name.
BNS and Atrocities Act Invoked
The police net which is cast over the accused is wide. Khan has been slapped with several stringent charges under the “Bharatiya Nyaya Sanhita” by the authorities. The following provisions are specific to sexual harassment, intentional acts to offend religious sensibilities and criminal defamation. Moreover, the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act has been invoked. The reason for it is that one of the main victims is a marginalized group and it has given the severity of the laws considerably a boost.
The part played by Tausif Attar
Khan was not the only one to allegedly engage in this complicated network of work pressure. Tausif Attar, another employee who was suspended, is also named as one of the main masterminds by the police, who allege Khan was in league with him. Attar is alleged by investigators to be returning from a religious trip with “deeply radical views.” He is said to have taken advantage of the personal misfortunes of weak colleagues. In one disturbing case, he allegedly offered to cure an employee’s father of his paralysis if he converted to Islam.
Uncovering the Corporate Blind Spot
The most surprising aspect of the whole story is the failure of the internal corporate safeguards. In reality, Khan was a member of an internal complaints committee set up to address issues of harassment under the POSH Act. She didn’t protect victims, but instead covered up their cries for assistance. Dozens of emails and distress calls were never received by the management hierarchy, investigators found. This blatant oversight enabled the abuse to go on unabated for about four years.
What is the meaning of the word “local”?What does the term political and local connections mean?
The manhunt for Khan uncovered political linkages in the heartland of Maharashtra. During the raid, the Nashik crime branch found her hiding with another woman in the Naregaon area. Police claim that local corporator of the AIMIM, Mateen Majid Patel, was actively sheltering her and giving her safe haven. Patel was immediately arrested and designated as a co-accused in the massive case. Local political involvement, of course, has unleashed a huge battle of words between the state leaders, and no doubt among local politicians.
Tata Leadership Breaks Silence
The entire saga made it imperative for the highest echelons of the Tata group to step in. Rumors had spread on the internet initially that Tata Sons Chairman N. Chandrasekaran was totally uninformed about the conversion angle. According to the company’s official statements, however, that’s a pure myth. Chandrasekaran publicly commented on the issue, stressing that the allegations on the rise is a grave matter, and it’s a very disturbing one. He was not pretending to be unaware of the seriousness of the religious or sexual assertions by the employees.
No Tolerance and Internal Probes
But the Chairman’s answer was to take immediate and stringent action rather than sweeping the sordid details under the carpet. He confirmed that the giant company is a strict “no coercion” company. A high-level and intense internal probe is ongoing. The entire investigation is being led personally by the TCS Chief Operating Officer (COO) Arathi Subramanian, who is also chair of the TCS Data, Design and Technology Committee. The entire investigation is headed by TCS Chief Operating Officer (COO) Arathi Subramanian, who is also the chair of TCS Data, Design and Technology Committee. The company has already suspended all the employees who have been named in the nine pending police FIRs.
Undercover Police Operation.
The local police were not drawn to the BPO by a random call and began arresting people at random. Nashik City Police conducted a very covert and undercover operation of fourty days which resulted in them getting hard evidence. Inside the facility they used female constables who were dressed up as regular housekeeping. These undercover police officers watched the victims and documented the toxic interactions they had with them and gained their trust. The first official police case was only registered in late March after the police had obtained conclusive evidence.
The future of the SIT
An eleven-person special investigation team is still working the scene of this corporate debacle. SIT is currently monitoring digital footprints, deleted WhatsApp group chats and communications between the suspended HR officials. They also are investigating if any outside money is behind this purported radicalization push within such a high-traffic corporate environment. The Nashik police is busy as it has eight FIRs filed and eight persons arrested.
Shockwaves Through the IT Sector
The repercussions of the incident at the Nashik campus have reverberated around the IT sector in one of India’s fastest-growing industries. Corporate HR departments are in a rush to look at their own internal reporting processes. It is not a happy thought for corporate governance that an internal complaints committee member could be the one who is the main instigator. Businesses are beginning to understand that routine annual compliance training may not be sufficient to help prevent targeted, systematic harassment.
Social Media Fuel and Misinformation
The internet has been awash with speculation about the arrest. There are claims and counter-claims, and high temperatures religious arguments everywhere on the various platforms. The police have stated that they have substantiated the main charges of harassment and coercion, but also advised extreme public caution. In the larger Nashik area, authorities are attempting to quell rumours which could instigate communal tensions. The SIT believes in just hard forensics and not internet outrage.
