Netflix’s popular comedy show has gotten a spanner in the works recently. The Great Indian Kapil Show did a special episode of World Laughter Day. Veteran comic Sunil Pal and internet celebrities Samay Raina and Ranveer Allahbadia were also a part of the function. Tuners in had hopes for some comradery between the various generations of entertainers.
The segment, on the other hand, turned into a sustained attack, straight on Sunil. Samay got several jabs at the senior comedian during the episode. The internet rapidly divided into two positions regarding the broadcast. The sharp, modern humor received endorsements from some fans as a breath of fresh air. Others thought that Sunil was being unnecessarily humiliated in a large-scale streaming platform.

Recently Sunil broke his word in regards to the Netflix shoot. He told Zee Switch that he was utterly taken aback by the setup. The producers first extended him an invitation to do his renowned family-friendly stand-up act. He was dressed in traditional comedy attire and ready for a comedy set.
Fortunately, he never did set up a solo stand-up routine. The format was entirely turned over with an attack on roasting. Sunil admitted that he was not ready to make such a sudden turn around. As cameras continued to roll, he felt hemmed in by the younger creators.

Sunil says his own “retaliatory” jibes were “cut out” from the final cut. He didn’t go so far as to attack the production team for treachery outright. He did say, however, that what he expected was very different from what he got in the shooting. What he believed was a respectable performance became an attack to be belittled.
He just set foot in a wild world that he had not promised to enter into in advance. The public airing of grievances triggered a huge discussion on the moral boundaries of television humor. Recently, the Indian criminal justice system was revamped and the Indian Penal Code was replaced by the Bharatiya Nyaya Sanhita in India. Previously, defamation was a part of Section 499 of IPC. In modern times, the law with regard to the harm of reputation is set in Section 356 in BNS
There is not much of a change in the basic definition of the crime compared to the previous code. Section 356 also provides that “any imputation made or published with the intention of causing any person to be discredited is defamatory. A statement is defamatory when it reduces a person’s credit in the eyes of the average person. Roasts are supposed to poke fun, make fun of and overdo the imperfections for the benefit of the audience.
But there’s a difference between harmless stage talk and malicious character assassination. If the puns actually insinuated that Sunil was unprofessional or did something shady, then they could be considered lawful. Words have a tremendous range of meanings depending on the context of a comedy show.
To be taken seriously by a reasonable person, the BNS requires that the statement be acted upon by a reasonable person. When the audience knows the sentences are “exaggerations” just for a laugh, it creates a formidable obstacle to establish defamation. A number of exceptions have been included in Section 356 to shield from criticism and free speech. Absolute truth is one great defense. It is not defamation if the imputation is totally accurate and is for the public benefit. The public performance and artist exception is also very important.
If a player or singer goes on a public platform, he or she exposes his or her performance to public scrutiny. It is perfectly legal to simply offer a good faith opinion on that particular performance. Sunil Pal is a public figure and is working on a mega television show, which is open to criticism.
Samay could use this exception if his jabs were just about Sunil’s comedic style or his previous public statements. Beware of roasting in public: Usually allowed if performed in good faith. The legal safeguards typically fail in cases of personal attacks in no way related to a person’s public life.
The burden of proof and potential punishments.
If the complaint is filed formally, it will be the complainant’s responsibility to prove the harm. It would be Sunil’s job to prove that his reputation has been damaged, in a real and quantifiable way in the industry. The unedited footage would be reviewed by the court and the context of the streaming platform analysed.
They would have to decide whether or not the general people would feel bad about Sunil for Samay’s particular criticism. If it is proven that someone has indeed committed a crime under the BNS then the punishments are clearly stated. Offender may be imprisoned for up to 2 years on a simple charge.
They also might face significant monetary penalties. The new BNS also provides for community service, as an alternative penalty in defamation cases. This could result in someone being forced to do public service rather than being locked inside a cell.

But, he is as yet not sensing any kind of formal legal move against Samay Raina. He has made no complaints to the police about the Netflix episode. The entire incident is just a reminder of the evolving and unpredictable comedy scene in India today.
The fighting between the old school stand-up guys and the new breed of aggressive internet roasters has started to become conspicuous. The BNS has strong laws to safeguard reputations, but how to apply them to a comedy stage is a complex challenge. The feud is being played out solely in the comments of YouTube videos and press interviews.
