The Calcutta High Court just did a lot of throwing of curveballs in the case of the RG Kar Hospital tragedy. In the wake of the death of a young trainee doctor nearly a year and a half ago, the wheels are beginning to turn again in the legal wheelhouse. A special division bench consisting of Justices Shampa Sarkar and Tirthankar Ghosh handed down a major order on Thursday. They directed the Central Bureau of Investigations to assemble a completely new Special Investigation Team within 48 hours.
This team will not simply be flipping through the old case files and signing off. The court is requesting that they pay close attention to an extremely narrow window. They have to walk back through all the details of the night from the time the young woman sat with friends for dinner on August 9, 2024. They must go along this exact path till the next evening when she was cremated. The team will have three members headed by the joint director of the eastern zone CBI. They have a deadline that’s close. They have to come back to the judges with a comprehensive report by June 25.
The Parents Refuse to Back Down
This new probe was requested by the victim’s parents. They have been battling a raucous legal fight for the past year and seven months. One of the former civic volunteers, Sanjay Roy, is already jailed. The central agency finished its initial investigation, and he received a life sentence for the crime. The first charge-sheet had him as the lone attacker. However, the family would not have been swayed by that.
They were represented in court by a lawyer who posed some rather awkward questions. There is much more to the conspiracy than they think. The parents have stated that the crime took place in a different area of the school from the seminar hall, located on the third floor of the emergency building. They believe that the body had been moved after it was found. They also noted that the doctor’s delivery boy, who brought her dinner, was not thoroughly investigated by the Kolkata Police. Even the central agency doesn’t seem to have gotten this message. The central claim of the family is that their daughter was aware of some dark secrets and illegal activities that were going on within the hospital. They believe someone had tried to muzzle her.
The search for the Cover-Up
One thing is abundantly clear in the court order. The judges are giving weight to the claims of a huge cover-up. The new investigative team is made up of investigators who specifically have the charge of investigating matters of evidence tampering. The division bench said in its earlier report dated March, 2025, it identified some shortcomings in the conduct of the local police. The hospital administration also made some extremely questionable decisions in the first few hours of the emergency.
The local police faced no interference when dealing with the crime scene until the high court spirited off the mess to the central agency back in August 2024. The parents have in turn repeatedly claimed that there was a concerted effort to remove any clues before the central investigators had even arrived. The new team was informed to check with the parents’ complaints again. They have to determine whether anyone attempted to cover up the true perpetrators. The team can go back to the parents and interview them again and also get any new witnesses who they think might have some of the pieces. During the hearing, the central agency lawyers admitted they had questioned around eighty people over the last nineteen months. The court still had a few holes that needed to be filled, however, and they were big holes.
Shockwaves of politics, cops are suspended.
An important aspect of the RG Kar case is that it shook the political establishment in West Bengal.Discuss the RG Kar case without discussing the political earthquake it caused in West Bengal is impossible. The killings of the brutal murder erupted in the streets. It eventually made a crash through the voting booths. The Bharatiya Janata Party made the issue a big campaign issue during the recent state assembly elections. They agreed to do a house cleaning. They even handed over an election ticket to the victim’s mother Ratna Debnath. She contested from Panihati constituency. And she won. She won by over twenty 8-thousand votes. Salwa was visited by both Prime Minister Narendra Modi and Home Minister Amit Shah, who went there just to campaign for her.
Soon after the election win, the consequences were felt by the police force. The newly sworn in Chief Minister Suvendu Adhikari dropped the hammer just a few days ago. He suspended the commissioner of the Kolkata police, Vineet Goyal, who was in charge of the police department at the time of the murder. Both Abhishek Gupta and Indira Mukherjee, two senior officers of the IPS, were also suspended. Adhikari alleged that the initial response was “utterly misjudged” by them. He also raised the issue that they went and gave a gift to the grieving parents immediately after the body was discovered. The state government is now conducting its own investigation. They want to see if those officers acted on their own or if they were taking direct orders from higher-up politicians in the previous administration.
The countdown to June has begun!
Now the central agency has to deal with the continued political fallout and have to run against time. The judges took pains to state that they did not go after the current investigating officer, Seema Pahuja, on her credibility. They said that a new pair of eyes, at the highest level, was needed to look at the social impact of the crime. The depth of its fear among working women was too great to be neglected.
