
Section 58 of the Bharatiya Nyaya Sanhita, 2023: Concealing Plans to Commit Serious Offences

A person who, with the intention of facilitating or knowing that it is likely that they will thereby facilitate the commission of an offense that is punishable with death or imprisonment for life, voluntarily conceals the existence of a design to commit such an offense by any act or illegal omission, or by using encryption or any other information hiding tool, or makes any representation that they know to be false respecting such a design, is subject to the following penalties, as stated in Section 58:
* In the event that the offense is committed, the individual will be subject to a financial penalty in addition to being sentenced to imprisonment of any description for a period of time that may extend up to seven years.

In the event that the offense is not committed, the individual will be subject to a fine in addition to being sentenced to imprisonment of any description for a period of time that may extend up to three years.
An Illustration to Make Section 58 Transparent
For the purpose of elucidating this provision, the BNS provides the following example:
A, who is aware that a dacoity is about to be done at B, gives the Magistrate a false report that a dacoity is about to be perpetrated at C, which is a location in the opposite way. As a result, A intentionally misleads the Magistrate in order to enable the conduct of the offense. In accordance with the design, the commission of the dacoity takes place at B. The violation of this section is penalized by A.
