The petition filed by Latha Rajinikanth, a film producer and a wife of a superstar Rajinikanth, in a court of Bengaluru to be discharged in a criminal case filed against her on charges of cheating and forgery has been dismissed by the court. This will result in her now having to stand trial in the protracted battle that involves the financial dealings of the 2014 animated film, ‘Kochadaiiyaan’.
It was on a private complaint filed by Ad Bureau Advertising Private Limited, a Chennai based firm that this case was initiated. The complaint shows that the Mediaone Global Entertainment Ltd owned by Latha Rajinikanth had borrowed [?]10 crore of the Ad Bureau to do the post-production work of the film. As part of the deal, Ad Bureau allegedly had the distribution right of the film in Tamil Nadu or, as the alternative, return of their investment with assured profit.
The main focus of the accusations is the inability to follow this agreement. Ad Bureau alleged that they sold the distribution rights to a third party, and thus they were denied their justified returns, and this amounted to cheating. In addition, the complaint contains a forgery allegation which states that Latha Rajinikathan forged a letter allegedly authored by the Publishers association of India to prevent press houses to report the financial conflict.

In the case, the defense counsel of Latha Rajinikanth claimed that there was not enough evidence to go to trial and that the case was not criminal, but civil. They asked the court to dismiss her in the case. Nevertheless, the prosecution and the defense of Ad Bureau argued that the case against her had a prima facie evidence and there was enough material out there to warrant a full trial on the charges of cheating and forged documents. The court ended up supporting the prosecution where it would not grant her discharge. This decision opens the way to the trial, during which evidence will be officially introduced and investigated.
