In a big blow to Delhi-based former DHFL promoter Dheeraj Wadhawan, the Supreme Court on Tuesday quashed the medical bail that was previously granted to him by the Delhi high court in an alleged multi-crore bank loan fraud case related to the DHFL case (CBI v. Dheeraj Wadhawan, SLP). The topmost court ordered Wadhawan to submit within two weeks and asked the jail officials as well as the Central Bureau of Investigation (CBI) to provide him with specialised medical care according to the suggestions made by a medico-legal board appointed by the court.
The Delhi High Court had granted him bail on health grounds on the basis that his medical conditions were so severe that it could not be taken care of within the confines of the judicial custody. The high court, nevertheless, noted that the medical report of a board that was constituted earlier this year by 11 doctors did not indicate that she needed to be hospitalised.
On July 9, the medical panel sent in its report to the court; seeking to conclude that Wadhawan need not be taken to a hospital and that he could go forward with his treatment, which would consist of medicines, physiotherapy, and regular medical check-ups, inside the jail. These findings were held by the Supreme Court not to justify one to continue to be released on bail and the judgment of the High Court was overturned.
Wadhawan is accused in the Yes Bank-DHFL scam in which there have been mammoth irregularities and fraudulent advances to the tune of thousands of crores and both CBI and Enforcement Directorate (ED) probed Wadhawan. The ruling by the court is interpreted to have strengthened the view that medical bail should be heavily adjudicated particularly in economic crimes of high stakes.
