Daler Mehndi’s ₹35-Lakh Performance Row: Can an Event Organiser Interrupt a Paid Singer Without Breaching the Performance Contract?

Uttarakhand Minister Disrupts Daler Mehndi Show

Punjabi singer Daler Mehndi has come into controversy as Uttarakhand Cabinet Minister Subodh Uniyal was seen stopping him mid way at a cultural programme in Tehri Garhwal.

On 18 October 2026, the singer was singing in front of a gathering at the annual fair. A video of the incident, which was being shared on social media, showed the minister walking onto the stage and berating Mehndi on stage.

“Mehndi was not able to sing properly and he was looking out of sorts,” Uniyal added. “I asked if Mehndi was singing as he was not sounding right, was he singing the song or was a jingly sound playing in the background.”

Later, the minister disclosed that the organisers had paid ₹35 lakh in advance and had also looked after their lodging. He said an artiste getting such a high fee was supposed to perform well.

The lawsuit has posed a noteworthy legal concern on the rights of event organisers and performers. Can a paid performer’s performance be interrupted by the organiser and did that act itself constitute a breach of contract?

He said the organisers had paid in advance the entire sum of ₹35 lakh and had spent on the singer’s stay and related expenses.

Uniyal asserted that Mehndi seemed to not be capable of doing what was needed. He said that he suspected the singer was drunk or high on some other intoxicant.

That assertion has yet to be independently proven. Singh’s brother and singer Mika Singh dismissed the claims that he had taken alcohol and said that his family singer was ill.

Uniyal subsequently said he was aware of Mehndi’s alleged illness when he stopped the show. He argued that the organisers should have been notified if the singer had not been fit to perform.

He added that he had no intention of personally insulting the artist Mehndi and only did so out of concern that the event might not be “up to the mark” according to audience demand.

What Does the Indian Contract Act Say About Paid Performances?

A professional engagement is generally governed by a contract between the singer and the event organiser.

The contract might include the performance fee, date, place, reporting time, technical requirements, conditions for cancelling and both participant’s duties.

Section 37 of Indian Contract Act, 1872 states that: ‘The parties to an agreement must either perform, or offer to perform, their respective promises unless the performance is dispensed with or excused under the law.’

Where a singer’s undertaking is to sing for a fixed period against payment, the normal expectation is that the singer would perform for the stated period.

Otherwise, the organiser is required to pay the performer as agreed and ensure that all the necessary facilities and a fair chance are given for the performance to be fulfilled.

That the preliminary payment of ₹35 lakh was allegedly made in advance does not, without more, entitle the organiser to unilaterally seek to interrupt, degrade, or terminate the performance.

Whether such action would be legally justified would then depend on the terms of the agreement, the particular performance and conduct of the parties.

Can an Event Organiser Legally Stop a Singer Mid-Performance?

There may be a reason why an event organiser has to cut a performance short or put it on hold.

For example, action should be taken in the event of a significant safety issue, when there is a medical emergency, if a condition of the contract has been seriously breached or if there has been a significant failure to deliver the agreed service.

A performance agreement may also contain specific provisions that allow organisers to both suspend and terminate a show for particular reasons.

Yet, not being satisfied with the performance of an event does not force a right to public interruption of the event.

Indian contract act, the party who has refused to perform or disables himself from performing a promise wholly, the other party who has to perform the promise in some cases can consider the contract to be discharged subject to the statutory qualification.

A performance in which a shareholder does not perform however, is probably not a complete refusal to perform, as the meaning would depend on the promisor.

Section 53 is also applicable if one of the contracting parties prevents the other from performing. It states that where there are reciprocal promises and one of the contracting parties prevents the other from performing the contract, then the contract will become voidable at the option of the party preventing the performance.

An organiser preventing a singer from fulfilling her contractual performance without good reason could, therefore, create some legal issues for the organiser.

Can Daler Mehndi Be Held Responsible if He Was Unwell?

The whole affair has also prompted questions about whether it is necessary for a performer to reveal an illness ahead of booking or continuing to do an engagement.

The answer is that it will depend upon the illness and how it affects the ability to work and the requirements of the agreement.

If a singer knows that a major medical problem is going to prevent performance, they may have an obligation to inform the organiser or to activate any contractual right to cancel or postpone.

Nevertheless, some kind of”sickness” will not be the same as a misconduct or even breach of agreement.

Agreement to do impossible act, or unlawful act may be made & Agreement to do a thing impossible in itself. Medical condition. Whether a medical condition allows performance of a contract to be excused depends on the facts.

Temporary discomfort, lower quality voice and complete inability to perform due to medical reasons may not all be treated the same.

His family has alluded to health problems in Mehndi, while the minister has asked why the organisers were not given the notice sooner.

It would be unwise to determine that either of the parties had acted in breach of its contractual obligation in the absence of the agreement and sound medical evidence.

Can Organisers Demand a Refund of the ₹35-Lakh Performance Fee?

An event organiser may demand a refund or compensation when the performer does not deliver the services that were contracted for.

But whether the right to the money can be recovered depends on the terms of the contract and the conduct of the alleged failure.

When compensation for loss or damage caused by breach of contract may be claimed?

In the usual way the organiser would have to determine the breach and the damage caused. If the singer had been able to perform part of the programme, then the value of the part performed and explanation for the breakdown might be of significance.

Section 74 will also be relevant where the agreement may include a payment for breach, for example a cancellation fee or liquidated damages clauses. It relates to the law on liquidated damages, where a sum is fixed for breach of contract in advance.

A transfer of ₹35 lakh does not, in itself, make it clear that the whole sum would have to be refunded on failure of performance.

Similarly, no performer is entitled to keep the full fee when there has been a contractually established breach of an obligation.

The appropriate remedy would therefore be a declaration as to the contract depending on the terms, evidence of the performance and the extent of any proved loss.
