MP CM Mohan Yadav’s Family Land Deal Faces Legal Scrutiny Over Alleged Misuse Of Official Position Under PCA

In a colossal realty scandal engulfing Madhya Pradesh at the moment, the spotlight of accusation falls squarely on the incumbent Chief Minister, Mohan Yadav, and his kin. A recently released report has quantified exactly how the Chief Minister’s relatives gobbled up sprawling parcels of land in Ujjain, but critically, they managed it right before a series of massive infrastructure projects were greenlit in those very pockets. Opposition parties have been shouting about conflict of interest and abuse of power, and legal luminaries suggest the Prevention of Corruption Act could come into play.

The Dirty Details of the Land Deals

Let’s look at the hard numbers. An investigative report by the Indian Express exposed that the CM’s extended family and their associated real estate ventures acquired as much as 168 acres spread across 137 plots. The total cost ran up to roughly 45 crore rupees.

The key timing?

This acquisition spree commenced after Mohan Yadav was sworn in as Chief Minister in December 2023.

It’s not that buying land is illegal. Far from it. The problem lies in the locations.

Out of the 168 acres, a whopping 111 acres have been purchased literally on the fringes of newly announced government highway projects in Ujjain.

A significant portion of this land had previously been notified as agricultural before being recently re-zoned for commercial and residential use under the revised Ujjain Master Plan 2035.

Land value skyrockets when you get wind of a new road being built, or when agricultural land is re-zoned to become commercial real estate. If you have inside information, a direct line into those decision-making corridors, the potential for massive personal profit is enormous. And that’s the accusation: that the Yadav family, possessing that crucial insider information, leveraged it to secure a financially advantageous position. That’s exactly where the Prevention of Corruption Act becomes pertinent.

A Rolodex of Relatives and Companies

The legal documents paint a broad picture of family involvement. Among those names to have made it onto property deeds and corporate filings are Seema Yadav (the CM’s wife), Vaibhav (his son), Shalini (his daughter-in-law), Nandlal and Narayan (his brothers), Kalavati (his sister), Abhay (his nephew), and his first cousins Govind and Nilesh.

Not all land transactions were carried out under individual names. A large number of these purchases were channeled through four real estate companies which are purportedly under the family’s control, the most prominent of which is Siddhi Vinayak Devcon Pvt Ltd, in which Chief Minister Mohan Yadav and his wife Seema hold a commanding 73% share. Interestingly, during the 2023 assembly election campaigning, Mohan Yadav had declared ownership of just 17 acres, while his wife possessed about 13 acres. Combined, the extended family and their businesses are now alleged to hold ownership over 335 acres and 245 plots.

In a blistering press conference held in Bhopal, Congress state president Jitu Patwari and leader Umang Singhar did not mince words, labeling the entire affair “loot of Mahakal land.” They demanded an immediate judicial inquiry conducted by a sitting Supreme Court judge and wryly dubbed the whole situation the “Mohan Yadav Files.” Singhar pointedly asked what could be expected when the head of the state was occupied with real estate dealings and suggested that if he was dabbling in such activities, his ministers are likely no different. He also questioned the silence from central investigative agencies such as the CBI and the Enforcement Directorate.

The State Government’s Defense

As is typical in such sensitive matters, Chief Minister Mohan Yadav himself has maintained an uncharacteristic silence, and his office has chosen to refrain from responding to detailed media inquiries. However, behind the scenes, a concerted damage-control effort has been initiated, with government sources briefing journalists on condition of anonymity to push back against the allegations.

The primary thrust of their argument is that the Yadav family has been involved in the real estate business for years, a venture they were engaged in long before Mohan Yadav ascended to the Chief Minister’s post. Some sources expressed frustration at the attempt to drag the extended family into a political battle, adding that upon a cursory look at the holdings of the immediate family – his wife and son – nothing significant emerges.

One of Govind Yadav’s sons, Anant, spoke out to defend his father and uncle. He clarified that their family has been active in real estate development since 2010, stating their disbelief and questioning if they were expected to abandon their livelihood just because a relative became the CM. He further pointed out that the approval process for at least some of the highway projects adjacent to the land their family acquired predates Mohan Yadav’s tenure as Chief Minister. Adding to the counteroffensive, the state BJP chief, Hemant Khandelwal, dismissed the accusations as entirely groundless, asserting that the Chief Minister’s personal landholdings remain identical to his declarations in the 2023 election affidavit.

The Ujjain Master Plan and What’s Next

The state government has placed immense focus on Ujjain, largely in preparation for the Simhastha Kumbh Mela scheduled for 2028. To accommodate the anticipated millions of pilgrims, the government is investing heavily in infrastructure development, including the construction of new ring roads and the rezoning of vast tracts of agricultural land for hotel, ashram, and residential complexes.

This planned development push has been a source of contention even before the current scandal erupted. Late last year, the state government attempted to acquire approximately 1,800 acres of agricultural land near the Shipra river for Kumbh preparations. However, this move faced stiff opposition from local farmers, spear-headed by the Bharatiya Kisan Sangh (an affiliate of the RSS).

Now, those farmers have a unique vantage point from which to observe the Chief Minister’s family buying up Prime real estate while the state attempts to acquire their own farmland. The public perception, needless to say, is extremely unfavorable to the ruling party. The opposition has called for the public disclosure of all land-use change approval records for the areas where the Yadav family purchased land, specifically requesting details about the timing of these approvals vis-à-vis the actual land purchases.

Legally, the situation could become quite precarious for the state government should a direct connection be established between official decisions made by the Chief Minister’s office and the family’s real estate purchases. Pinpointing such a direct line is, as ever, the crux of the matter and incredibly challenging in practice. For now, with the opposition armed with considerable circumstantial evidence, the ball lies in the court of the central agencies or, potentially, a judicial probe to unearth the actual extent of the impropriety and move beyond mere political brinkmanship.
