Suspects suggest that Passia, operating out of India’s neighbor, the US, collaborated with Pak-based terrorist Harwinder Singh Sandhu, also known as Rinda. Thousands of miles away, they are manipulating, funding, arming, and directing their soldiers on the ground in India. They allegedly sent these young and misguided local recruits on reconnaissance missions to scout their targets before unleashing their deadly attacks. Court Observations

UAPA is one of the main charges he faces. This is India’s principal anti-terror legislation.

‘Terrorist act’ is defined in Section 15 of UAPA. Anyone who plans, tries to commit, helps, advises, encourages, or knowingly assists in carrying out a terrorist act or preparing for one can be punished with at least five years in prison, possibly up to life in prison, and a fine. Passia, the alleged ringleader, would presumably be prosecutable under this provision for his role in facilitating these attacks.

In addition to UAPA, Passia faces proceedings under The Explosive Substances Act, 1908. This law concerns explosive offenses.
