This position involves providing all-encompassing legal assistance to the beverage companies in India and Bangladesh, Nepal, and Sri Lanka. This position is intended for a seasoned legal professional with expertise in Food Law, Legal Metrology, Regulatory Affairs,Contracts and Commercial Laws,Litigation, and Advertising and Marketing Laws across the FMCG industry.
Position Summary The role requires delivering seamless legal support and strategic counsel to the business units within the beverage category in India and other regions.
Close collaboration with business teams, as well as various departments including Scientific and Regulatory Affairs, Public Policy & Government Affairs, product development, and nutrition science, is integral. The chosen candidate will provide counsel on legal and regulatory challenges related to product safety, branding, marketing efforts, and various commercial ventures. Beverage Business SupportAssist business leaders and teams in the beverage category with legal advisement and guidance on diverse business activities and channel initiatives. Work collaboratively with business leaders and other key stakeholders to analyze and mitigate brand and organizational reputational risks, including those arising from social media platforms.
Review and give legal approval on product launches, product claims, promotions, marketing campaigns, activation plans, and associated creative materials while ensuring adherence to all applicable regulations.
Assess the legal implications of new products, claims, and business propositions, offering practical legal solutions to facilitate business growth while maintaining robust compliance standards. Contract ManagementReview internal approval memos to ensure they comply with relevant Multi-Year Contract benchmarks and identify any significant legal risks. Draft, negotiate, and review legal documents governing celebrity endorsements, media acquisitions, promotional endeavors, client engagements, and other commercial arrangements.
Consequently, candidates should possess a strong command of both contract drafting and negotiation. Litigation and Regulatory MattersCollaborate with external counsels to strategize and manage marketing disputes within the beverage sector. Stay abreast of critical legal and regulatory developments and their potential impact on the business, informing stakeholders appropriately.
Liaise closely with Scientific and Regulatory Affairs and Public Policy and Government Affairs teams to address the legal and regulatory aspects of Food Law, Legal Metrology, and BIS specifications.
Assist in making suitable representations to relevant regulatory bodies to safeguard PepsiCo’s interests and guarantee business continuity. Training and ComplianceResponsible for educating employees and business teams about legal issues. Provide legal guidance and assistance on the Code of Conduct by working alongside Compliance and Ethics departments. Potentially train employees on FCPA and anti-bribery procedures.
Qualifications
Candidates must be a law graduate with 12 years of post qualification legal experience.
Demonstrable deep knowledge of food laws, legal metrology, social media legislation, and other relevant laws within the FMCG market. Strong skills in legal research, interpretation, drafting and negotiation are mandatory. The incumbent should possess excellent interpersonal and network-building abilities for effective engagement with the business and stakeholders.
Key SkillsIdeal candidates would have extensive experience in FMCG, food and beverages, commercial contracting, regulatory compliance, marketing regulations, and litigation. A thorough understanding of Indian food regulations, Legal Metrology regulations, BIS standards, and legal challenges concerning advertising and social media, is advantageous.
