I have the honour to address your good self as a recently superannuated officer of the District Judge Cadre (retired on 30.09.2026).

I submit this representation to draw your urgent attention to a series of escalating incidents of grave magnitude.

These developments carry an imminent threat of compromising the independence and severely damaging the institutional integrity of the Judiciary—which constitutes an unalterable part of the basic structure of our Constitution—besides possessing far-reaching, adverse ramifications for our democratic system of governance.

The targeted instances of distortion, intimidation, and misinformation undermining the judicial edifice are outlined below:

Political Exploitation of Judicial Observations:

A political entity, styled as the ‘Cockroache Janta Party’, has been deliberately floated by misappropriating and weaponising certain observations made by a three-judge Bench of the Hon’ble Supreme Court during judicial proceedings.

These courtroom observations are being systematically publicised and twisted to project an erroneous narrative, as if they were personal opinions expressed by the Hon’ble Chief Justice of India in a private capacity or at a non-judicial gathering.

This calculated misrepresentation is a matter of profound concern for the entire legal fraternity and judges across all levels who value the non-partisan character of the institution.

Targeted Social Media Smear Campaigns:

Social media platforms are being inundated with highly malicious, unfounded reels and video clips targeting the Hon’ble Chief Justice of India with deeply personal allegations.

This weaponization of digital media severely jeopardises the dignity of the highest judicial office and erodes public trust in the very foundation upon which our constitutional democracy rests.

Weaponization and Sensationalization of Live-Streaming:

While the live-streaming of daily court proceedings in the Hon’ble Supreme Court and various Hon’ble High Courts was conceptualised to foster transparency and public awareness, it has unfortunately been co-opted for malicious ends.

Doctored, truncated, and highly selective segments of hearings are being virally circulated out of context to falsely depict the judiciary as ideologically biased or politically motivated.

Distortion of Courtroom Dialogue:

Dynamic exchanges and oral observations exchanged between the Hon’ble Bench and learned members of the Bar during arguments are being stripped of their contextual legal relevance.

They are being publicised as definitive pronouncements driven by hidden agendas, completely disregarding the fact that oral dialogue is a crucial, deliberative element of the adjudicatory process.

Malicious Attribution of Political Motives:

Attributing political motives to judicial observations is a deliberate and coordinated attempt to tarnish the image of an independent judiciary.

Our courts discharge the extraordinarily onerous responsibility of administering justice to the citizenry under immense institutional strain, including severe understaffing and inadequate infrastructural support from the executive.

To vilify such an institution for political mileage is utterly impermissible.

Coercive Tactics and Intimidation over Case Allocation:

Public discourse and social media content are increasingly targeting the administrative prerogative of the Master of the Roster regarding case allocations.

Strikingly, no objections to the constitution of benches are raised by the litigating parties before or during the hearings.

Instead, a orchestrated campaign of browbeating and intimidation is unleashed only after an unfavourable order is delivered.

This calculated pattern of asymmetric warfare against judges clearly constitutes ‘Criminal Contempt’ under Section 2(c) of the Contempt of Courts Act, 1971.

Politicization of Judicial Dissent:

The expression of a dissenting view, which is a celebrated and constitutionally protected aspect of multi-judge benches, is being falsely projected as a systemic anomaly.

Dissenting judgments are being attributed to personal malice, hidden political agendas, or collateral benefits, which directly scandals the court and constitutes a gross offense against the administration of justice.

Binary Categorization of Judges:

In instances of split verdicts or strong dissents, the positions of individual Hon’ble Judges are being reductive-labeled by commentators as either “pro-Government” or “anti-Government,” or as favoring specific litigants.

This binary politicization interferes with the due course of judicial proceedings, creates an atmosphere of unwarranted suspicion, and damages the image of the judiciary as a neutral, uninfluenced arbiter.

Subversion of Separations of Powers via Private Audiences:

Attempts by political figures to seek private audiences with the Hon’ble Chief Justice of India to discuss active constitutional or legal matters—many of which may already be sub-judice—is a concept entirely foreign to our constitutional architecture.

Such actions directly violate the doctrine of separation of powers and threaten the institutional neutrality and appearance of absolute impartiality expected from the judiciary.

Orchestrated Pressure Tactics and Marches:

Organising political marches from Barakhamba Road to the precincts of the Hon’ble Supreme Court to exert extra-judicial pressure for partisan gains, followed by widespread sensationalization across print, electronic, and social media, represents an overt attempt to scandalise the court and lower its authority.

Disruption within Court Precincts:

Incidents of political actors entering the sacred precincts of the Hon’ble Supreme Court to create a ruckus, followed by aggressive self-promotion on digital platforms, constitute a direct, unlawful interference with the peaceful administration of justice.

Fabrication of False Narratives:

The systematic dissemination of twisted, exaggerated, and entirely fabricated narratives surrounding ordinary courtroom events on social media is designed to cultivate public distrust, manipulate public perception, and alienate the common man from the judicial system.

Erosion of the Rule of Law:

Immediate, decisive legal and regulatory intervention is the need of the hour.

If these malicious attempts to undermine the Hon’ble Supreme Court, the Hon’ble High Courts, and the District Judiciary are left unchecked, they will permanently tarnish the image of the “Third Pillar” of our democracy, compromise the rule of law, and fatally erode public faith in the administration of justice.

In light of the above, I earnestly request the All India Judges Association to take the following immediate measures:

Initiation of Legal Action:

File comprehensive First Information Reports (FIRs) under relevant penal provisions in jurisdictional police stations as well as invoke the NSA proceedings, across India against the perpetrators of these malicious campaigns.

Contempt Proceedings:

Move the Hon’ble Supreme Court and various Hon’ble High Courts to initiate suo motu Criminal Contempt proceedings against individuals and entities engaged in browbeating judges and scandalising the institution.

Injunctive Relief:

Institute appropriate civil and writ proceedings seeking an immediate temporary/permanent injunction against the publication of such derogatory material, alongside urgent directives to social media intermediaries for the take-down of offensive reels, videos, podcasts, and articles.

Urgent General House Meeting:

Convene an extraordinary General House Meeting of the AIJA to formally condemn these institutional attacks, pass a resolution asserting unwavering solidarity, and demonstrate absolute unity among judges across all tiers of the judiciary.

Regulation of Live-Stream Content:

Advocate for the formulation of stringent, comprehensive guidelines governing the use, editing, and reproduction of live-streamed court proceedings, ensuring that no unauthorized, truncated, or out-of-context clips are published without prior written permission from the concerned court.

Ban over/derecognition of political parties and self proclaimed social media influencers/bloggers/activists/columnlists/politically aligned lawyers, who are attacking the independence of Judiciary:

Seek ban over political parties to take part in elections who are indulged in such ill motivated activities aiming to tarnish the image of independent Judiciary, scandalize and undermine the authority of Courts, which are exfacie motivated for political gains by spreading hatred against judiciary as such activities carry potential of spreding hatred among different sections of our citizenry too.

Similarly, seek ban over such social media users to use any social media platform for spreading such hatred.

Thank you for your time, consideration, and leadership in preserving the majesty of our courts.

With highest regards,

Yours sincerely,

Dinesh Kumar Gupta
