Delhi School Fee Hike Post-New Government: Constitutional Analysis of Right to Education Under Article 21A
Concerns have been expressed over the accessibility and affordability of education, particularly for families with middle-incomes and lower-incomes, as a result of the recent pricing increases implemented by private schools in Delhi. As a reaction, the government of Delhi has introduced the Delhi School Education (Transparency in Fixation and Regulation of Fees) Bill, 2025. The purpose of this bill is to regulate fee structures and provide transparency. Under Article 21A of the Indian Constitution, which protects the right to free and compulsory education for children aged six to fourteen, this article investigates the constitutional consequences of such fee hikes. Specifically, the study focuses on the ramifications of such increases. In addition to this, it investigates the legal frameworks, judicial interpretations, and the potential effects that the new legislation may have on the school system in Delhi.
