Section 40 of the Bharatiya Nyaya Sanhita, 2023: Commencement and Continuance of the Right of Private Defence of the Body

The Bharatiya Nyaya Sanhita (BNS), 2023, which took the place of the Indian Penal Code, is the comprehensive legal document that sets the basis for criminal law in India. The right to private defense in relation to one’s body is expressly addressed in Section 40 of the BNS, which also discusses the length of the right. Because of this provision, individuals are able to safeguard themselves against threats or attempts to do injury, even before the commission of an actual offense can take place.

The question is, when does the right start?

Section 40 states that the right to private defense of the body begins as soon as a reasonable apprehension of danger emerges from an attempt or threat to commit an offense, even if the offense has not yet been committed. This is the case even if the offence has not officially been committed. Consequently, if a person believes that they are in danger of experiencing a true threat to their bodily safety, they have the legal right to take the necessary actions to defend themselves.

Therefore, the right will continue to exist for as long as there is a continuing fear of harm.
